UN Body Calls on Saudi Arabia to Release Palestinian Detainees

News - Middle East: The United Nations Working Group on Arbitrary Detention confirmed that the Saudi authorities’ continued deprivation of liberty of Mohammad Salih al-Khudari and Hani Mohammad al-Khudari is an arbitrary measure.

In a report issued following its 91st session last September, the group stressed that the basic human rights of Palestinian detainees in Saudi prisons have been violated.

“The appropriate remedy is to release them immediately and grant them an enforceable right to compensation,” it added.

The group’s report stated that the working group found that the detention of Palestinian detainees in Saudi prisons is arbitrary for three reasons. The Saudi government failed to establish a legal basis for the arrest and detention of Mohammad Salih al-Khudari and Hani Muhammad al-Khudari, therefore, “their detention is arbitrary of the first category”

Second reason is that “violations of the right to a fair trial are so serious as to give their detention an arbitrary character,” and that “the detention of the Al-Khodari family suggests that they were targeted on the basis of their status as Palestinian citizens residing in Saudi Arabia.”

The Working Group considered that Al-Khudari's case, along with many other cases in Saudi Arabia, raises its serious concern about "a systematic problem of arbitrary detention in Saudi Arabia, which amounts to a serious violation of international law."

The report stated that the Working Group’s decision was based on the facts of the detention. Dr. Mohammad Al-Khodari, his son and Dr. Hani Al-Khodari were arrested on 4 April 2019. Their arrest and detention was part of what Amnesty International described as a “wider campaign of repression by the Saudi authorities against Palestinians residing in Saudi Arabia.”

In early 2019, the Saudi authorities arrested more than 60 Palestinian citizens living and working in the Kingdom of Saudi Arabia with alleged links to Hamas. Palestainian detainees were working as doctors, engineers, academics, businessmen and students.

Reports indicate that this group of Palestinian detainees has been subjected to grave human rights violations, including fair trial violations and physical and psychological torture by prison officials and interrogators.

The working group’s decision importantly acknowledges the discriminatory measures taken by Saudi Arabia against a group of 60 Palestinians who were arrested en masse, as their arrest was found to be “arbitrary” because it was “discriminatory.”

According to the report, after their arrest in April 2019, Dr. Mohammad and Dr. Hani Al-Khodari were denied any information about the legal reason for their arrest or any charges against them during the first 11 months of their arrest, and charges were brought against them only on the first day. of their arrest.

Most importantly, the Working Group found that this treatment constituted violations of their basic human rights to a fair trial and due process.
